MERGER OF THE POSTS OF LDC & UDC-LETTER TO DoPT SECRETARY

Sub: Merger of the posts of LDC & UDC and granting of Rs. 2800/ grade pay-regarding.

Sir,
It is to submit that this Association had sent a letter vide letter No.1/GS/2010 dated 16/04/10 to the Hon’ble Prime Minister, Government of India on the above subject. The Prime Minister’s Office had forwarded the same to your office vide letter No PMO ID No. 4/3/2010-PMP4/158890 dated 18/05/2010 for further action, a copy of the same was endorsed to us also (copy enclosed). But this Association had not received any information from your office on the action taken at your level, so far.

In this respect it is again submitted that the difference of the Grade pay of LDC & MTS is only Rs. 100. It is astonishing to see that the Pay Band for the posts of MTS, LDC and UDC is the same and as such the existing employees do not get any benefit compared with the new recruitees. But the educational & technical qualifications on which these LDCs have been selected by the Staff Selection Commission are far different from the required qualifications for erstwhile Group D or the present MTS. DoPT had circulated the duties of MTS which is only a reproduction of the duties of the erstwhile group D staff. How can they be compared with the quality work and responsibilities assigned to the LDC/UDC in the Administrative Offices especially field offices of the Government of India. Moreover LDCs and UDCs in Government of India Offices, especially its Field Offices are doing the same work.

Thus the merger of the posts of UDC & LDC and granting of Rs. 2800 is highly essential to boost up the morale of the already distressed LDC & UDC. An early action on the matter is requested please.

  1. Sir, I am working as UDC in ITBP,MHA, G.O.I., can this benefit / upgradation of Gr. pay from 2400 to 2800 if allowed will be admissible to me. Please clarify. Sir.

  2. 1. It is very good proposal over all, but it needs some modification. The Grade pay of the LDCs should be Rs.2800/- and of the UDCs should be Rs.4200/- and any merger required, there should be the merger of UDCs & Assistants. The logic behind this is that the minimum educational qualification for UDCs and Assistants is same (i.e. Graduation), both comes through the same examination and almost nature of duty is the same as per CS-MOP (Manual of Office Procedure), difference is only the cadre. There should not be discrimination on the basis of Cadre.

    The principle of “Equal pay for equal work” should be applied in case of UDC also. Some important judgment of Hon’ble Supreme Court on the principle of “equal Pay for equal work” is RANDHIR SINGH V. UNION OF INDIA & ORS., AIR 1982 SC 879; STATE OF HARYANA & ORS v. RAJPAL SHARMA AND OTHERS, AIR 1996 SC;
    The principle of equal pay for equal work has been confirmed many a time by the Hon’ble Supreme Court and it is adopted by the Central Govt. and State Government in many of the cases too. Why, this principle is not applicable to UDCs (Clerical Cadre). Why this Cadre will always be deprived of granting Fundamental Rights provided under Article 14 (Equality before law) and Article 16 (Equality of opportunity in the matter of public employment – (1) There Shall be equality of opportunity for all citizen in matters relating to employment or appointment to any office under the State). The apex Court has held that the word ‘employment or appointment’ were wide enough to include tenure, duration, emoluments and duties and obligations, whether the employment is temporary or permanent. They cover amongst themselves not merely the initial appointment, but also salary, increments revision of pay, promotion, gratuity, leave, pension etc. ( Champak Lal v. Union of India, AIR 1964 SC 1854; Shiv Charan v. State of Mysore, AIR 1965 SC 280 (282); Union of India v. Kashikar, AIR 1986 SC 431. We should represent this submissions to the respective Governments through Associations.

AS PER THE CADRE REVIEW OR CADRE RESTRUCTURING AMONG VARIOUS DEPARTMENTS, THE BASIC LEVEL POSTS LIKE LDC AND UDC HAS TO BE PHASED OUT COMPLETELY AND ONLY ASSISTANT LEVEL & SECTION OFFICER LEVEL POSTS SHOULD BE RETAINED. BECAUSE THE NATURE OF WORK AND RESPONSIBILITY ARE THE SAME. HENCE THE MERGER OF LDC & UDC AT THE EARLIEST, WILL ENCOURAGE ALL THE GROUP C STAFF. AND IT CAN BE ALSO SUGGESTED THAT GAP PERIOD FROM UDC TO ASSISTANT SHOULD BE RELAXED TO 3 YEARS. AS ALMOST ALL THE GROUP C STAFF ARE GRADUATES AND POST GRADUATES WITH REQUIRED SUITABLE EXPERIENCE.

  7. As per DOPT letter dated 31 Jan 2011 "up gradation of udc/ldc grade pay is under consideration by Anomaly Committee of DOPT". But No action has been taken by DOPT/NAC. If Govt accepts this with the financial effect wef 01.01.2006 this will benefit to all new / existing LDC/UDC. If Govt accepts this with financial effect from the date of order the benefits of this shall go only for new recruits of LDC/UDC. Please note this all LDC/UDC of Central Govt.   8. I fully support to Mr.V.Venunath. The Authorities of FOD should consider the matter to retain only the post of Assistant and Section Officer instead of LDC / UDC and OS. Due to it the working of Administration will boost up in field offices.
